Terms of Service

The agreement that applies when you use FolioPage. Please read it carefully - by creating an account you agree to it.

1. Acceptance of these Terms

Welcome to FolioPage, a service for building and publishing portfolio websites. These Terms of Service (the "Terms") are a binding agreement between you and FolioPage ("FolioPage", "we", "us", "our"). They apply to the website at foliopage.com, the FolioPage dashboard, every portfolio site published through FolioPage, and any related services we provide (together, the "Service").

By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of a company or another organisation, you confirm that you have authority to bind it, and "you" then refers to that organisation as well.

You must be at least 18 years old to use the Service. By using it, you confirm that you are.

2. Definitions

  • Account - your FolioPage user account, identified by your email address.
  • Site - a portfolio website you create and manage through the Service, including every page, app, and setting that belongs to it.
  • Content - everything you upload, enter, or publish through the Service: text, images, videos, documents, links, code, and any other material.
  • Visitor - anyone who views or interacts with one of your Sites.
  • Plan - the feature set and limits that apply to a Site: Free, Pro, or Max, as described on our pricing page.
  • Subscription - a recurring payment arrangement for a paid Plan on one Site.

3. Your account

You need an Account to use the Service. You agree to give us accurate, current information when you sign up and to keep it up to date. Each Account belongs to one person; you may not share your login details or let anyone else use your Account.

You are responsible for keeping your password confidential and for everything that happens under your Account, whether or not you authorised it. If you suspect your Account has been accessed without permission, tell us right away at [email protected].

We will send you service emails about your Account, your Sites, and your payments (for example, renewal reminders, failed-payment notices, and security alerts). These are part of the Service and cannot be turned off while your Account is open. Marketing emails are optional and you can opt out at any time from your notification settings or the link in the email.

4. Plans, pricing and payment

4.1 Plans

Each Site is on one Plan. The Free plan costs nothing and has limited features. Pro and Max are paid Plans, billed per Site, monthly or yearly. Current prices, features, and limits are published on our pricing page and in the dashboard. Prices are shown in the currency offered at checkout and, where we are required to, include applicable taxes such as VAT.

4.2 Payments are handled by Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you buy a paid Plan, you are also entering into an agreement with Paddle under Paddle's Buyer Terms, and Paddle collects payment, calculates and remits taxes, and issues your invoices. Charges appear on your card or bank statement under Paddle's name (for example "PADDLE.NET* FOLIOPAGE"). You can reach Paddle's payment support directly at paddle.net. We may work with additional payment processors; the processor handling your purchase is always shown at checkout.

You agree to provide a valid payment method and authorise Paddle to charge it for the Plan you choose and for every renewal until you cancel.

4.3 Automatic renewal

Subscriptions renew automatically at the end of each billing period (monthly or yearly) for the same period, at the price in force at the time of renewal, unless you cancel before the period ends (see section 5). You can see your next renewal date in the Plans & Usage area of your dashboard.

4.4 Upgrades

You can upgrade a Site to a higher Plan or a longer billing period at any time. Upgrades take effect immediately and the prorated difference for the rest of the current period is charged right away. We do not offer downgrades between paid Plans. To move to a lower Plan, cancel your current Subscription; when it ends you can subscribe to a different Plan or move the Site to the Free plan.

4.5 Failed payments

If a renewal payment fails, Paddle will retry it and notify you. If payment is still not received, your Subscription ends and the Site becomes inactive: Visitors see a notice instead of your Site until you resubscribe, move the Site to the Free plan (which may require reducing its content to Free limits), or delete it. Your Content is kept while the Site is inactive, subject to section 15.

4.6 Price changes

We may change our prices. Any change applies to your Subscription from its next renewal after we have given you at least 30 days' notice by email. If you do not agree with a new price, cancel before the renewal and you will not be charged it.

4.7 Chargebacks

If you believe a charge is wrong, please contact us or Paddle first so we can fix it. Opening a chargeback or payment dispute without contacting us may result in the affected Site being suspended until the dispute is resolved.

5. Cancellation and refunds

5.1 Cancelling

You can cancel a Subscription at any time from the Plans & Usage area of your dashboard. The cancellation takes effect at the end of the billing period you have already paid for: the Site keeps its paid features until then, after which it becomes inactive as described in section 4.5. You can undo a scheduled cancellation before the period ends.

5.2 Refunds

You can request a full refund of any payment within 14 days of the date of that payment, for any reason. This applies to every payment made for a paid Plan, whether it is the first payment, a renewal, or an upgrade. To request a refund, email [email protected] from the address on your Account, or contact Paddle directly at paddle.net, and tell us which Site and payment it concerns. Refunds are processed by Paddle, our Merchant of Record, under Paddle's refund policy and are returned to the original payment method, normally within 5 to 10 business days.

When a payment is refunded, the Subscription ends immediately and the Site returns to the Free plan limits (section 4.5). If you want to stop paying but your last payment is more than 14 days old, cancel the Subscription instead: the Site keeps its paid features until the end of the period you have paid for, and nothing further is charged.

5.3 Your statutory rights

Nothing in this section limits the rights that mandatory consumer protection law gives you, including any right to withdraw from a distance contract.

6. The Free plan

Sites on the Free plan are provided at no cost and with reduced limits (such as the number of pages, sections, and media files, storage space, and available features) as described on our pricing page. Free Sites display a small "Made with FolioPage" attribution, which you may not remove, hide, or alter while on the Free plan.

We may unpublish a Free Site, and later delete it together with its Content, if nobody has signed in to its Account for 12 months. We will email the Account's address at least 30 days before unpublishing and again before deleting, and signing in at any point during that time keeps the Site active. Deleted Sites cannot be recovered after the deletion.

7. Your content

7.1 You own it

You keep all rights, including copyright, in your Content. We do not claim ownership of anything you upload or publish.

7.2 The licence you give us

So that we can run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, back up, resize, transcode, cache, transmit, and display your Content as needed to operate, secure, and improve the Service and to deliver your Sites to Visitors. This licence lasts for as long as your Content is on the Service plus a reasonable period for backups to expire, and then ends, except for Content you have shared publicly that others have already copied.

7.3 Showcasing your Site

We may feature your published Sites (for example, as a screenshot or link in our templates gallery, on our website, or on our social channels) to show what can be built with FolioPage. We will always credit the Site to its address and will not alter your Content. If you would rather not be featured, email [email protected] and we will remove the feature within 14 days.

7.4 Your responsibilities

You are solely responsible for your Content and for the Sites you publish. You confirm that you own your Content or have every right, licence, and permission needed to use it and to grant us the licence above, including from any people who appear in your images or videos, and that your Content and Sites comply with the law and with section 9.

7.5 Backups

We take reasonable measures to protect your Content, including routine backups of our systems, but we are not a backup service. Keep your own copies of your original files.

8. Your visitors and their data

Your Sites are yours, and you are responsible for how they treat Visitors. If your Site collects personal data from Visitors (for example, through a contact form), you are the data controller of that data and we act as your processor, handling it only to deliver it to you and operate the Service. You are responsible for complying with the privacy laws that apply to you, including providing any privacy notice or cookie consent that your Visitors are entitled to. FolioPage offers tools to help, such as a cookie banner, but using them does not by itself make your Site compliant.

Contact-form submissions are emailed to the address on your Account and are not stored on the Service after delivery. Monthly submission limits apply per Plan.

9. Acceptable use

You agree not to use the Service, and not to publish Content, that:

  • breaks any law or regulation, or infringes anyone's copyright, trademark, privacy, publicity, or other rights;
  • is sexually explicit involving minors, promotes violence or terrorism, or is defamatory, harassing, or hateful towards any person or group;
  • is deceptive: phishing, impersonating a person or organisation, fake reviews, fraudulent offers, or pages designed to mislead Visitors or search engines;
  • distributes malware, spyware, or any code designed to harm, intercept, or take over devices or data;
  • sends unsolicited bulk messages or uses the Service to send spam, whether through forms, links, or otherwise;
  • promotes or sells illegal goods or services, counterfeit products, or anything that payment providers classify as prohibited;
  • consists mainly of file hosting, media hosting, or redirects rather than a genuine portfolio or personal website;
  • attempts to probe, scan, bypass, or break the security of the Service, to access other users' Accounts or data, or to interfere with the Service's operation or resources;
  • copies, scrapes, reverse engineers, or builds a competing product from the Service's software, templates, or design system; or
  • resells or offers the Service to third parties as your own without our written agreement.

We may, but are not obliged to, review Content, and we may remove or disable access to any Content or Site that we reasonably believe breaches these Terms or exposes us or others to harm or liability.

10. Subdomains and custom domains

10.1 Free subdomain

Every Site gets a free address on a FolioPage domain (for example, yourname.folio.page). These domains belong to us; you receive a limited licence to use your chosen subdomain for as long as your Site exists and you comply with these Terms. You may not choose a subdomain that impersonates someone else, infringes a trademark, or is misleading or offensive, and we may reclaim or change a subdomain in those cases, when the Site is deleted, or when required for the operation of the Service.

10.2 Custom domains

On paid Plans you can connect a domain that you own. We do not register or sell domains: you buy and renew your domain with a registrar of your choice, keep it in your name, and stay responsible for it. To connect it you point its DNS at the Service; we then provision routing and a TLS certificate for it through our infrastructure partners. If your domain lapses, is misconfigured, or is disconnected, the Site stays reachable at its free subdomain.

11. Custom code and third-party services

Paid Plans let you add custom CSS and HTML (including scripts) to your Site. That code runs on your Site exactly as you enter it. You are responsible for it and for anything it loads, and you must make sure it does not break your Site, harm Visitors, or breach section 9.

The Service links to or integrates with services run by others, such as payment processing (Paddle), content delivery and DNS (Cloudflare), fonts, social networks, and any third-party service you embed. Those services have their own terms and privacy policies, which you accept when you use them. We do not control them and are not responsible for their availability, content, or conduct.

12. Our intellectual property

The Service, including its software, templates, sections, design system, icons, imagery, text, trademarks, and logos, belongs to FolioPage or its licensors and is protected by copyright and other laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service and its templates to build and publish your Sites. You may not copy, export, or reuse templates, sections, or design assets outside the Service, or use our name or logos without our written permission. The "Made with FolioPage" attribution on Free Sites is part of this licence.

If you send us suggestions or feedback, you agree that we can use them without any obligation to you.

13. Copyright complaints

We respect intellectual property rights and expect our users to do the same. If you believe that Content on a Site infringes your copyright or another right, email [email protected] with: the address of the Content; a description of the work you say is infringed; your contact details; a statement, made in good faith, that the use is not authorised by you, your agent, or the law; and a statement that your notice is accurate and that you are the rights holder or authorised to act for them.

We will review complete notices and may remove or disable access to the Content, notify the Site owner, and give them the chance to respond. We may terminate the Accounts of users who repeatedly infringe others' rights.

14. Fair use

Some Plans describe features as "unlimited". This means we do not set a fixed numerical cap, not that resources are infinite. The Service is intended for portfolio and personal websites with the traffic and storage needs typical of such sites. If a Site's usage is far beyond what is reasonable for that purpose, or affects the performance of the Service for others, we may contact you to discuss options, apply limits, or, in serious cases, suspend the Site. We will always try to reach you first.

15. Suspension and termination

15.1 By you

You can delete any Site at any time from its settings. Deleting a Site takes it offline immediately, ends any Subscription on it at once (section 5 applies to refunds), and starts a 7-day recovery window during which you can restore it from your dashboard. After that window the Site and its Content are permanently erased from our systems, except for backups, which expire on their normal schedule. To close your Account entirely, delete your Sites and email [email protected].

15.2 By us

We may suspend or terminate your Account or any Site, with notice where reasonably possible, if: you materially breach these Terms; a payment for a Site remains unpaid; we are required to by law or by a court or authority; the Site presents a security, legal, or reputational risk to us, to other users, or to Visitors; or we discontinue the Service (see section 16). For Free Sites, section 6 also applies.

15.3 Effect

When a Site or Account is terminated, your right to use it ends and its Sites stop being served. Unless the termination was for a breach of these Terms, or the law prevents it, we will give you a reasonable opportunity to export or copy your Content before it is deleted. Sections that by their nature should survive termination (including 7.2 for backups, 12, 18, 19, 20, 21, and 22) continue to apply.

16. Changes to the Service

We are constantly improving FolioPage, so features, templates, and limits will change over time. We may add, modify, or remove features, and we will try to do so in a way that does not harm your published Sites. If we remove a feature that is material to a paid Plan you have already paid for, or discontinue the Service altogether, we will give you reasonable notice by email and refund the unused part of any prepaid period.

We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. Planned maintenance, emergencies, and events outside our control may cause downtime.

17. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or through the dashboard at least 30 days before it takes effect; minor changes (such as clarifications or updated contact details) are effective when posted. The "Last updated" date at the top shows the current version. If you do not agree to a change, stop using the Service and cancel your Subscriptions before it takes effect; continuing to use the Service after that date means you accept the updated Terms.

18. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be error-free, secure, or uninterrupted, that defects will be corrected, or that any particular results (such as search-engine rankings, client enquiries, or sales) will follow from using it. Nothing in this section affects any warranty or guarantee that the law says cannot be excluded.

19. Limitation of liability

To the fullest extent permitted by law, FolioPage, its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, or data, arising out of or related to the Service or these Terms, however caused, even if we were advised of the possibility.

To the same extent, our total liability for all claims arising out of or related to the Service or these Terms in any 12-month period will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) EUR 50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for damage caused intentionally or by gross negligence, or for anything else that cannot be excluded or limited under the law that applies to you. If you are a consumer, you keep every right that mandatory consumer law gives you.

20. Indemnification

You agree to defend, indemnify, and hold harmless FolioPage and its directors, employees, and partners from any claim, demand, loss, or expense (including reasonable legal fees) brought by a third party and arising from your Content, your Sites, your Visitors' use of your Sites, your breach of these Terms, or your violation of any law or of anyone's rights. We will notify you of any such claim and may take over its defence at our own expense. This section does not apply to the extent that the law where you live does not allow it for consumers.

21. Governing law and disputes

21.1 Complaints

If something has gone wrong, tell us first at [email protected] and we will try to put it right. We acknowledge every complaint within 2 business days and aim to resolve it within 14 days; if we need longer, we will tell you why and when to expect an answer. Complaints about a payment, invoice, or refund can also be raised directly with Paddle, our Merchant of Record, at paddle.net.

21.2 Governing law

These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service that we cannot resolve informally will be brought before the competent courts of Plovdiv, Bulgaria.

21.3 Consumers

If you are a consumer living in the European Union, you also benefit from any mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country. Before starting any formal proceedings, please use the complaints route in section 21.1 - most issues can be sorted out quickly that way.

22. General

  • Entire agreement. These Terms, together with our Privacy Policy and any Plan-specific terms shown at checkout, are the entire agreement between you and us about the Service and replace any earlier agreements.
  • Assignment. You may not transfer your Account or these Terms to anyone else without our consent. We may assign these Terms to an affiliate or to a successor in a merger, acquisition, or sale of assets, and will notify you if we do.
  • Severability. If any part of these Terms is found to be invalid or unenforceable, that part will be applied to the greatest extent permitted and the rest will remain in full effect.
  • No waiver. If we do not enforce a provision, that does not mean we give up the right to enforce it later.
  • Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of infrastructure providers, natural disasters, or acts of government.
  • Notices. We will send notices to the email address on your Account; keep it current. You can send notices to us at the addresses in section 23.
  • Language. These Terms are written in English. Any translation is for convenience only; the English version prevails.
